It is the case that whilst a higher volume of Personal Injury cases occur in the Insurance Litigation market, in any given year, there are also a significant number of different disputes within the broad Insurance Litigation arena that do not involve Personal Injury but involve an element of assessment of damages, be it from a Claimant or indeed Defendant perspective.
Such disputes can have many different facets but one of the most common disputes (within the non Personal Injury sphere) which we are requested to act on are cases involving business interruption.
Such disputes occur when, as a result of the negligent actions of someone or some entity an individual / company suffers losses through essentially the loss of use of a business asset, whether this is a relatively small business asset such as a taxi (in one extreme) or alternatively the loss of a whole factory / trading division of a business (at the other extreme).
