It is an unfortunate fact, but the nature of mankind is such that individuals fall out, for whatever reason, and this trait obviously occurs in business relationships in the same way as elsewhere.
Such termination of business “marriages” can have a catastrophic effect on the operation of a business and its continuance, with ongoing ramifications for business value etc, and the legal process can be interminable.
At Forths we have been instructed many times to consider many different aspects of shareholder and partnership disputes to provide the Court with guidance as to what has happened in certain areas etc.
It is not just business valuations that we are requested to undertake, in the context of such disputes, in addition we are often asked to consider misappropriation of funds, accounting treatments, perceived diminutions in shareholder value (i.e. minority shareholder disputes) as examples.
